Terms & Conditions

1. Introduction

1.1 These Terms and Conditions (“Terms”) govern the relationship between AirplaneClaim (“we”, “us”, “our”) and the client (“you”, “your”).

1.2 By submitting a claim, you agree to these Terms and enter into a legally binding agreement with AirplaneClaim.

2. Assignment of Claim

2.1 By accepting these Terms, you irrevocably assign and transfer to AirplaneClaim full ownership, legal title, and rights to your claim for compensation against the operating airline.

2.2 This includes claims under UK261, EU Regulation 261/2004, and any applicable international or national passenger rights laws.

2.3 AirplaneClaim shall have full authority to pursue, negotiate, settle, and enforce the claim in its own name or on your behalf.

3. Authority to Act

3.1 You authorise AirplaneClaim to:

(a) act on your behalf in all matters relating to your claim;
(b) communicate with airlines, regulators, and legal representatives;
(c) submit claims and supporting documentation;
(d) initiate legal or administrative proceedings where necessary.

4. Payment and Fees

4.1 AirplaneClaim operates on a no-win, no-fee basis.

4.2 If the claim is successful, AirplaneClaim is entitled to a success fee of 30% of the total compensation recovered.

4.3 Compensation shall be paid directly to AirplaneClaim.

4.4 AirplaneClaim will deduct its fee and transfer the remaining balance to you.

4.5 If compensation is paid directly to you by the airline:

(a) you must notify AirplaneClaim immediately;
(b) you remain legally obligated to pay the agreed fee within 7 days.

5. Client Obligations

5.1 You confirm that:

(a) all information provided is accurate and complete;
(b) you have not assigned or transferred the claim to any third party;
(c) no other agreement exists regarding the same claim.

5.2 You agree that you will not:

(a) pursue the claim independently;
(b) accept settlement directly from the airline;
(c) engage another claims company for the same claim.

6. Claim Process

6.1 AirplaneClaim will assess your claim and determine whether to pursue it.

6.2 AirplaneClaim has sole discretion to accept, reject, or discontinue any claim.

6.3 AirplaneClaim may attempt to resolve the claim directly with the airline or escalate it to dispute resolution bodies or legal proceedings.

7. Legal Proceedings

7.1 Where necessary, AirplaneClaim may initiate legal or administrative proceedings.

7.2 You agree to provide any additional documentation required for such proceedings.

7.3 AirplaneClaim will bear the costs of pursuing the claim unless otherwise agreed.

8. Settlement Authority

8.1 AirplaneClaim has full discretion to accept or reject settlement offers from airlines.

8.2 You agree that AirplaneClaim may settle claims where it considers it appropriate.

9. Payment to Client

9.1 Payments to you will be made via the payment method provided during submission.

9.2 You are responsible for providing accurate payment details.

9.3 AirplaneClaim is not liable for delays caused by incorrect or incomplete payment information.

10. Termination

10.1 This agreement terminates when the claim is resolved and payment has been made.

10.2 AirplaneClaim may terminate the agreement if:

(a) the claim is unlikely to succeed;
(b) false or misleading information has been provided.

10.3 If you withdraw after work has begun, AirplaneClaim reserves the right to charge reasonable administrative or legal costs.

11. No Guarantee

11.1 AirplaneClaim does not guarantee successful recovery of compensation.

11.2 Claim processing times may vary depending on the airline and external factors.

12. Data Protection

12.1 Your personal data will be processed in accordance with applicable data protection laws, including UK GDPR.

12.2 Your data will be used solely for the purpose of pursuing your claim.

13. Limitation of Liability

13.1 AirplaneClaim shall not be liable for:

(a) decisions made by airlines, courts, or regulators;
(b) delays outside our control;
(c) indirect or consequential losses.

14. Governing Law

14.1 These Terms shall be governed by the laws of Scotland.

14.2 Any disputes shall be subject to the jurisdiction of the Scottish courts.
